The buzz words, “Labour Reforms”, are not unfamiliar to the Business Community as well as the Trade Unions for the last over 3 decades. The Central Government brought “Economic Reforms” all of a sudden in the year 1991, resulting in Globalization of Trade & Business . Economic Reforms calls for immediate Labour Reforms to provide a helping hand in terms of eliminations of legal constraints & hurdles to the Indian Industry. Indian Industry was saddled with multiple legal restrictions causing hurdles for organizing /reorganizing/ rationalization of process & methods and most importantly the productivity etc. This was not attended to. Ever since, the Indian Business Entrepreneurs have been consistently pressurizing and pursuing the Central Government to bring out “Labour Reforms” to ease of doing Business due to global competitiveness with cost, quality and delivery. The Business constantly urged upon the Central Government, in order to invite Foreign Direct Investment, the productivity coupled with international quality as also the cost effectiveness which are the main criteria’s, and insisted on the Central Government that flexibility in engagement of human resource, and to eliminate the legal hurdles and restrictions pertaining to modernization, adaptation to the latest technology, rationalizations and method improvements etc are the primary essentials. As we have witnessed, the Central Finance Ministry would talk of the word “Labour Reforms” during the Finance Budget presentation every year. Indian Business would get motivated and attracted towards the steps to be taken with eagerness. The Trade Unions, upon hearing the word “Labour Reforms” would get emotionally charged and call for protest including organizing & inciting a “Bhart Bundh”. Next, the Central Government, watching the protest, no further initiatives, and the year is gone. These are the chain of events, going on year on year.

Ltd, Antharasanahalli, Tumkur President Greater Nelamangala Industries Association, Nelamangala A simple issue or a petty demand, which would have otherwise easily ignored or given up or agreed had led to the serious damage to the very existence of the industry. I can give many examples starting from a petty demand for a plastic cover to carry confectionery items sold at discounted prices in the company for the employees, which actually triggered high magnitude industrial unrest and eventually led the closure of industry which also left more than 500 families on the street.Take another example, we must have read this in the newspaper, a company decided to lockout because of 10 Paisa disagreement in the settlement (an example occurred about 20 years before) and left more than 1000 families on the street. What do we understand by this? The Union or the workers would have ignored simply or given up or the management would have agreed to consider it, as it was a petty matter. The more realistic approach would have avoided the industrial unrest and the company would have continued the existence. It is all about maturity of people. Had they thought a little and acted maturely, serious trouble would have been averted. Is there a solution or an approach to deal with such complexities?One can find answers to these in the maturity model or the Human Relations/Human Factor based approach. I have dealt the conventional approach and Human Relations approach in detail in this article. I have also dealt what actions and approach of an employer leads to building progressive unionism which benefits both employers and workers at large.

ಎಂ.ಆರ್. ನಟರಾಜ್ ಉದ್ದಿಮೆಗಳನ್ನು ನಡೆಸುತ್ತಿರುವ ಕೈಗಾರಿಕೋದ್ಯಮಿಗಳು ತಮ್ಮ ಸಂಸ್ಥೆಯ ಲಾಭಾಂಶಗಳು ಕಡಿಮೆಯಾದಂತೆ ತಮ್ಮ ಸಂಸ್ಥೆಯ ಖರ್ಚು ವೆಚ್ಚಗಳನ್ನು ಕಡಿಮೆಗೊಳಿಸುವ ಪ್ರಯತ್ನಗಳನ್ನು ಮಾಡುವುದು ಸಹಜ. ಕಚ್ಚಾ ವಸ್ತುಗಳ ಕೊರತೆ, ಸಿದ್ದ ವಸ್ತುಗಳ ಅತ್ಯಧಿಕ ದಾಸ್ತಾನು, ಯಂತ್ರೋಪಕರಣಗಳ ದುರಸ್ತಿ, ಬೇಡಿಕೆಯ ಕೊರತೆ ಮುಂತಾದ ಪರಿಸ್ಥಿಗಳು ಉಂಟಾದಾಗ ಉದ್ಯೋಗದಾತರು ಇನ್ನಿತರ ಖರ್ಚು ವೆಚ್ಚಗಳನ್ನು ಕಡಿಮೆ ಮಾಡುವುದರ ಜೊತೆಗೆ ಸಂಸ್ಥೆಯಲ್ಲಿನ ಉದ್ಯೋಗಿಗಳನ್ನು ಕಡಿಮೆ ಮಾಡಿ ಆ ಮೂಲಕ ಕೂಡಾ ತಮ್ಮ ವೆಚ್ಚವನ್ನು ತಗ್ಗಿಸುವ ಪ್ರಯತ್ನಗಳನ್ನು ಮಾಡುತ್ತಲೇ ಬಂದಿರುತ್ತಾರೆ. ಆದರೆ ಕೈಗಾರಿಕಾ ವಿವಾದಗಳ ಕಾಯಿದೆಯು ಉದ್ಯೋಗಿಗಳನ್ನು ಕೆಲಸದಿಂದ ಬಿಡುಗಡೆ ಮಾಡುವುದು ಅಥವಾ ಕೆಲಸ ವಿಮುಕ್ತಿಯ (ರಿಟ್ರೆಂಚ್ಮೆಂಟ್) ಬಗ್ಗೆ ಹಲವಾರು ನಿಯಮಗಳನ್ನು ರೂಪಿಸಿದೆ. ಹಾಗಾಗಿ ಕಾರ್ಮಿಕರನ್ನು ಕೆಲಸದಿಂದ ಬಿಡುಗಡೆ ಮಾಡುವುದಕ್ಕೆ ಮೊದಲು ಉದ್ಯೋಗದಾತರು ಕೈಗಾರಿಕಾ ವಿವಾದಗಳ ಕಾಯಿದೆ ಮತ್ತು ನಿಯಮಗಳಲ್ಲಿ ತಿಳಿಸಿರುವ ಅಂಶಗಳಿಗೆ ಭಾದ್ಯರಾಗಿರತಕ್ಕದ್ದು.
ಉದ್ಯೋಗಿಗಳ ತೊಡಗಿಸಿಕೊಳ್ಳುವಿಕೆ ಅಂದರೆ ಏನು ?
ಉದ್ಯೋಗಿಗಳ ತೊಡಗಿಸಿಕೊಳ್ಳುವಿಕೆ ಎಂಬುದು ಸಾಂಸ್ಥಿಕ ಮಾನವ ಸಂಪನ್ಮೂಲ ನಿರ್ವಹಣೆಯ ವಿಭಾಗವನ್ನು ವಿಶೇಷವಾಗಿ ಲಗ್ಗೆ ಹಾಕಿದೆ (ವಿಭಾಗದಲ್ಲಿ ಬಹಳವಾಗಿ ಮಿಂಚುತ್ತಿದೆ). ಶತಮಾನಗಳಷ್ಟು ಹಳೆಯದಾದ ಪೂರ್ವದ ಪರಿಕಲ್ಪನೆಗಳಾದ ಕುಟುಂಬ (ಎಂಬ ಸಂಸ್ಥೆ), ಪರಸ್ಪರ ಸಂಬಂಧ (ಅವಲಂಬನೆ), ಪ್ರೀತಿ ಇವುಗಳನ್ನು ಬಳಸಿ ಕಾರ್ಯಸಾಧನೆ ಮತ್ತು ಸಕಾರಾತ್ಮಕ ಫಲಿತಾಂಶ ಪಡೆಯಬಹುದು ಎಂಬುದು ಇಲ್ಲಿಯ ಸಂಸ್ಕೃತಿಯ ಭಾಗವಾಗಿಯೇ ಇದೆ. ಈಗ ಇದು ಪಶ್ಚಿಮದ ಸಾಂಸ್ಥಿಕ ರೂಪರೇಷಿಗೆ ಅಳವಡಿಕೆಯಾಗುತ್ತಿರುವುದು ಹೊಸದಾಗಿ ಮತ್ತು ಆಸಕ್ತಿದಾಯಕವಾಗಿ ಕಾಣಿಸುತ್ತದೆ.
